Welcome to Shots! By downloading, installing, or using the App, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. These Terms may be updated from time to time, and such updates will take effect immediately upon posting on the App or Website. You are responsible for reviewing these Terms periodically, and your continued use of the App constitutes acceptance of any updated Terms.

2. User Eligibility

To use the App, you must be at least 18 years old (or the age of majority in your jurisdiction). By accessing the App, you represent that you are eligible to use the services offered.

3. Account Registration

To access the full functionality of the App, you must create an account. During registration, you will be asked to provide certain information, including but not limited to your phone number (and optionally your email address). 5. Location Data

You can control location settings through your device, but disabling location tracking may limit your ability to use certain features of the App.

6. User-Generated Content

You are allowed to upload and display content, including text, images, videos, and other media ("User Content") to create your profile. You are solely responsible for the content you upload, and you agree not to post any content that:

  • Violates the rights of others (including intellectual property and privacy rights).

  • Is abusive, discriminatory, offensive, or illegal.

  • Contains harmful or malicious software.

We reserve the right to monitor, review, and remove any User Content at our sole discretion, especially if it violates these Terms or is reported by other users. You retain ownership of your User Content, but you grant us a worldwide, royalty-free license to use, display, and distribute it as part of the App's services.

7. Content Moderation

We will moderate and monitor content posted on the App to maintain a safe and respectful environment. We may suspend, delete, or block any account that violates our content guidelines or engages in inappropriate behavior. However, we do not guarantee the immediate removal of all violating content.

8. Prohibited Conduct

You agree not to:

  • Engage in harassment, abuse, or offensive conduct toward other users.

  • Use the App to engage in fraudulent or deceptive practices.

  • Post or transmit content that is harmful, illegal, or infringes upon any third-party rights.

  • Use the App to solicit personal information from other users.

9. Advertising and Analytics

While the App is free to use, we may implement third-party advertising and analytics services to improve your experience and support our operations. These services may collect personal information, including your location and browsing behavior, in accordance with their respective privacy policies. By using the App, you consent to the use of these third-party services.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in illegal or abusive behavior, or violate community guidelines. 11. No Guarantees

We make no guarantees that the App will be error-free or continuously available. The App is provided "as-is," and we disclaim any warranties, whether express or implied. We are not responsible for any interruptions, errors, or data losses that may occur while using the App.

12. Limitation of Liability

To the fullest extent permitted by law, Shots shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to damages for loss of data or profit, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Shots, its officers, employees, and agents from any claims, damages, losses, or liabilities arising out of your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Changes to Terms

We may update these Terms at any time, and such changes will be effective immediately upon posting. You can access the most current version of the Terms within the App. We may notify you of material changes via in-app notifications, but it is your responsibility to periodically review these Terms.

15. Dispute Resolution

Any disputes arising from your use of the App or these Terms will be governed by the laws of North Carolina. You agree to resolve any disputes through binding arbitration or mediation as outlined in our Dispute Resolution Policy.
